Home Occupation Permit

Any work or business activity (such as a job, small business, profession, or livelihood) conducted by a member of the immediate family within a residence is classified as a home occupation. These activities are considered accessory to the dwelling unit and are permitted in DD (Detached Dwellings), AD (Attached Dwellings), and MD (Multiple Dwellings) settings.

A Home Occupation:

  • Must be conducted within a dwelling
  • Can only be operated by family members residing within the dwelling
  • Is not allowed to make any substantial internal or external alterations not customary in a dwelling, or display evidence indicating the operation of a business
  • Can NOT sell merchandise on the premises
  • Can NOT generate more than four (4) visits per day from clients or customers

Who can have a home occupation?

A home occupation permit allows members living within a single-family dwelling or apartment to run a small business from their home. Only the members living in the home can be involved in the home occupation.

Can I have a business in my garage?

No, the occupation must be located entirely within the home.

Can I sell a product?

No. Merchandise sales are prohibited at the home. Any products you sell must be delivered or shipped to your customer.

Can I keep a pickup truck or van at my home?

Personal passenger or service vehicles can be parked at your residence. Service vehicles may incorporate attachments to support service functions; however, they are not utilized to perform specific commercial functions.

What about signage for my home occupation?

You may have a non-illuminated one-square-foot wall sign. There should be no other evidence indicating the operation of a business.

How do I obtain a home occupation permit?

Verify you meet the qualifications of a Home Occupation by completing the Home Occupation Application. If you qualify, submit your completed application online through Customer Self Service (CSS) or apply in person at the City Center, 231 N Dakota Ave, Sioux Falls, SD 57104.

Do I need any other permits or license?

If you make any structural changes, replumb, or rewire your home for the business use, you must also take out appropriate building permits and be inspected by Building Services.

If a sales tax license is required for your business, you will need to contact the South Dakota Department of Revenue. Personal service businesses may need to be inspected by City Health.
